Privacy Policy

Information on data privacy, data
processing and cookies.

For the operation of its online business, ClimatePartner is obligated to comply with certain legal requirements, especially the German Data Protection Act (BDSG) and the German Tele-Media Act (TMG).

1. Required data collection, processing and utilization
In order for ClimatePartner to render the services described in its GTCs or in a particular contract, it is necessary to collect, process and use personal data customers have given, for example, during registration or when entering payment details.
"Personal data" is all information concerning the personal or material circumstances of an identified or identifiable individual. For the purpose of registration, ClimatePartner asks for the following information: first name, last name and email address. In case of ordering a service that incurs a fee, customers are asked for a home address and for bank or credit card details in addition to their name.
Collection, processing and usage of personal data by ClimatePartner in the aforementioned manner will only be carried out within the limitations defined in the following provisions and only if customers agree to the treatment of their personal data by accepting this privacy policy. ClimatePartner will keep a record of their acceptance.
Please note: Customers are entitled to withdraw permission for the collection, processing and usage of personal data at any time, or to ask for the correction of personal data stored with ClimatePartner. For more detailed information, please refer to paragraph 4: "Exercise of usage rights: withdrawal of consent and data correction". However, if a customer withdraws consent, ClimatePartner will not be able to provide the customer with any or only a very limited service.

2. Further collection, processing und usage of personal data
ClimatePartner will not pass on any of a customer's personal data to third parties unless the customer has given explicit consent to this or if ClimatePartner is legally obligated to do so.
ClimatePartner will not contact a customer by telephone unless the customer has given explicit approval to contact by telephone.
Customers accept to receive an email newsletter from ClimatePartner. Customers are entitled to withdraw consent to receive email newsletters at any time. Please refer to paragraph 4: "Exercise of usage rights: withdrawal of consent and data correction."
Customers permit ClimatePartner to pass on the personal data in their profile to external service providers and partner companies of ClimatePartner for the purpose of sending emails and newsletters to customers in ClimatePartner's name and on its behalf.
In case a customer agrees to the aforementioned further collection, processing and usage of data, ClimatePartner will only use this data for the purposes the customer has approved. ClimatePartner will keep a record of the acceptance.
Please note: Customers are entitled to withdraw permission to the collection, processing and usage of personal data at any time or to ask for correction of personal data stored with ClimatePartner. Use of cookies
Some of the services ClimatePartner offers necessitate the use of so-called "cookies". ClimatePartner herewith explicitly informs customers that cookies are being used.
Cookies are small text files stored either for a limited period of time in the random access memory of a computer (so-called "session cookies") or stored on the hard drive of a computer (so-called "permanent cookies"). Cookies contain information, for example, on servers a customer has accessed, on services or payment methods a customer selected for past transactions. Cookies serve the primary purpose of storing a customer's personal settings on websites in order to offer customised services to customers and to make the use of services as convenient as possible since customers are able to visit websites without having to fill in all the personal information once again. Cookies are not designed to independently run programmes or to download a virus onto customers computers.
ClimatePartner uses session cookies, partner and affiliate cookies and permanent cookies.

Session cookies:
ClimatePartner uses so-called "session cookies“. These are not stored on the customer's hard drive and are deleted upon closing the browser. Session cookies are used particularly for login authentication during registration.

Partner and affiliate cookies:
Furthermore, ClimatePartner uses so-called "partner cookies“ or "affiliate cookies“. These cookies are set when customers access ClimatePartner's service via an advertisement on the website of an affiliate or partner. These cookies are needed for billing purposes between ClimatePartner and the partners and do not contain any personal information about customers. These cookies are deleted when customers register at the ClimatePartner website or upon expiration of the cookie's lifecycle.

Permanent cookies:
ClimatePartner uses so-called "permanent cookies“ in order to save personal settings customers have entered when using ClimatePartner's services. On the one hand, this ensures that customers find their personal settings when re-opening the ClimatePartner website and on the other hand, the cookie can automatically inform ClimatePartner of a customer's status, whether the customer already received certain information and advertisements or whether the customer took part in a survey. Permanent cookies are used for personalisation and optimisation of ClimatePartner's services.

Partner websites:
If ClimatePartner's service is integrated in a partner's website the partner can also use cookies. ClimatePartner does not control these cookies and is not responsible for the partner's practices. For their own safety, ClimatePartner advises customers to seek information on the particular partner's privacy policy.
Please note: Most internet browsers are set by default to accept cookies. Customers are entitled and able to disallow cookies or to have the browser ask for permission before allowing a cookie. However, if customers decide to refuse or deactivate a cookie they might not be able to use ClimatePartner's services fully and effectively.

 

3. Information on stored data
Customers are entitled to ask ClimateParnter for information on personal data, the purpose of data storage and the recipient of the data. This information is free of charge and will be given in written form.
An information request should include a copy of an ID ("Personalausweis" or passport), the email address registered with ClimatePartner and the customer's personal signature. It should be addressed in written and clearly legible form to

4. Exercise of usage rights: withdrawal of consent and data correction
All customers are entitled at any time to withdraw permission for the usage of their data, as described in detail above, or to ask for the correction of data stored with ClimatePartner.

5. ClimatePartner explicitly informs customers that, with the know-how currently available, data safety cannot be fully guaranteed for data transfer in open networks like the internet. In this respect, safety of the data customers transmit over the internet are the customers' own responsibility.
